Terms of Service

These Terms of Service (“Terms”) govern your use of the website at thejoinery.club and of the facilities operated by The Joinery, LLC at 8508 Fairway Pl, Middleton, WI 53562. By using this website, purchasing from us, registering for a class, or entering our facility, you agree to these Terms.

Several other documents work alongside these Terms and are incorporated into them by reference: the Membership Agreement, the Membership Policy, the Membership Hold Policy, the Class Attendance, Rescheduling & Refunds policy, the Shop Policies, the Assumption of Risk, Waiver and Release of Liability, and our Privacy Policy. Where a specific policy conflicts with these Terms, the specific policy controls.

1. Eligibility

You must be at least 18 years old to hold a membership, register for an adult class, or make a purchase. Household members and guests under 18 may use the shop only as described in the Membership Policy and Shop Policies, accompanied by a responsible adult member at all times. Children under 10 may not use the shop floor.

2. Membership

Memberships are sold as recurring subscriptions that renew automatically until cancelled. Dues, billing periods, cancellation timing, refunds, and holds are governed by the Membership Agreement. In summary: there is no minimum contract, cancellation is self-service through your member account, you must cancel at least five (5) days before your renewal date to stop the next charge, and dues already paid are non-refundable and not prorated.

Membership is personal to you and your household at the same address. It may not be shared with, lent to, or transferred to anyone outside your household. Access credentials — facial recognition and PIN — are individual, and you may not admit anyone to the building using your credentials except as permitted under our guest rules.

3. Classes & Events

Class registrations are sold as tickets for a specific class on specific dates. Cancellations, transfers, refunds, and missed sessions are governed by the Class Attendance, Rescheduling & Refunds policy. In summary: cancel at least 7 days before the first session for a full refund or a transfer into a later cohort; inside 7 days, registrations are non-refundable. If we cancel a class, you may choose a full refund or a transfer.

Class seats are limited and are filled in the order registrations are received. Member pricing requires an active membership at the time of registration. We may substitute instructors or adjust a session’s schedule when necessary; we will notify registered students of any change.

4. Store Purchases, Lumber & Materials

Lumber, sheet goods, hardware, and consumables are sold on-site through a self-serve honor system, recorded through the member store on this website. You agree to log every item you take, accurately and promptly. Wisconsin sales tax is applied to taxable goods, including materials, supplies, and class materials fees. Memberships and class tuition are not taxed.

Materials are sold as-is. Wood is a natural material and we make no warranty as to its grade, moisture content, dimensional stability, or suitability for any particular project. Unused, unaltered stock materials may be returned within 14 days in the condition purchased; cut, milled, or finished materials are not returnable.

5. Gift Certificates & Gift Memberships

Gift certificates carry a balance usable toward store purchases and classes. Gift memberships are redeemed at thejoinery.club/redeem-gift for a prepaid membership term. Gift certificates and gift memberships are non-refundable, are not redeemable for cash except where required by law, and cannot be replaced if lost. A prepaid gift membership does not renew automatically; it simply ends at the close of its term unless you choose to continue.

6. Safety, Conduct & Termination

Safety is a condition of access, not a suggestion. You must complete the Shop Safety & Orientation course before receiving shop access, follow all posted and published safety requirements, use required personal protective equipment, and stop work when asked to by staff.

We may suspend or terminate a membership, remove a person from the premises, revoke access credentials, or refuse a class registration for conduct that violates these Terms or our Shop Policies — including unsafe practice, harassment or discriminatory behavior, use of tools while impaired, damage caused by misuse, theft, or failure to pay for materials taken. Where a termination is for cause, dues already paid are not refunded.

The Joinery is intended for hobbyist and personal use. Commercial production and high-volume work require advance written approval from management.

7. Personal Property & Storage

You are responsible for your own tools, materials, and projects. The Joinery is not a bailee of your property and is not responsible for loss, theft, or damage to anything you bring or leave here, whether or not it is in an assigned storage location.

Storage is for active projects and for tools kept under a storage add-on. Items left in work areas, unlabeled, or abandoned may be removed by staff. If your membership ends, you must remove your property within 30 days; property left beyond that period may be disposed of at our discretion.

8. Your Work & Our Content

What you make here is yours. The Joinery claims no ownership of members’ projects, designs, or intellectual property.

The content on this website — text, photographs, videos, course materials, documentation, and the Joinery name and marks — belongs to The Joinery, LLC and may not be reproduced or redistributed without permission. Course and documentation access is for your personal use as a member and may not be shared outside your household.

We photograph and record in the shop for teaching and promotional purposes. Media consent is handled through the waiver you sign at signup. Members and guests taking their own photos or video must ask before capturing other people or their work.

9. Community Platforms

Access to our Discord server and other community spaces is a benefit of membership and is governed by the same conduct standards as the shop. We may remove access to community platforms independently of, or together with, shop access.

10. Assumption of Risk & Limitation of Liability

Woodworking is inherently dangerous. Before using any equipment you must sign our Assumption of Risk, Waiver and Release of Liability, which sets out the risks you accept and the claims you release. Nothing in these Terms limits liability for gross negligence, willful or wanton misconduct, or reckless or intentional acts, consistent with Wisconsin law.

To the maximum extent permitted by law, The Joinery, LLC is not liable for indirect, incidental, or consequential damages arising from your use of the facility, the website, or anything purchased from us. Our total liability for any claim relating to a membership, class, or purchase will not exceed the amount you paid us for it.

The website and its content are provided as-is, without warranty. We do not guarantee that any specific tool, machine, or space will be available at a given time; equipment goes down for maintenance and repair.

11. Payments & Chargebacks

Payments are processed by our payment provider; we do not store full card numbers. Keeping a valid payment method on file is your responsibility, and a failed payment may suspend access until it is resolved. If you believe you have been charged in error, contact us first — filing a chargeback in place of a cancellation or a refund request may result in suspension of membership and access.

12. Changes to These Terms

We may update these Terms and our policies as the shop changes. The current version is always posted here with its “Last Updated” date. Material changes affecting membership billing or cancellation will be communicated to active members by email. Continuing to use the facility or website after a change means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. Any dispute arising out of these Terms or your use of The Joinery will be brought in the state or federal courts located in Dane County, Wisconsin. If any provision of these Terms is found invalid, the remaining provisions stay in effect.
